Common Challenges with H-1B Visa Eligibility

H-1B eligibility is more demanding than many employers and workers expect. These are the issues that most commonly create problems with petitions. 

  • The degree requirement is stricter than many employers expect. USCIS's 2024 H-1B modernization rule confirmed that a position can accept degrees in more than one field. However, each accepted field must have a direct connection to the actual job duties. A broadly related degree, or one that only loosely connects to the role, won't meet that standard.
  • How you classify the position matters. Filing with an incorrect SOC occupational code can weaken an otherwise solid petition. Getting the classification right from the start is part of building a petition that holds up to scrutiny.
  • Third-party placements face additional hurdles. If a worker will be placed at a client site rather than working directly for the sponsoring employer, USCIS applies heightened scrutiny. Under the 2024 rule, the specialty occupation determination is based on the third party's actual job requirements, not the petitioning employer's description of the role.
  • A fee increase may affect your petition. A recent Presidential Proclamation introduced a $100,000 filing fee requirement for certain H-1B petitions filed on or after September 21, 2025. Limited exceptions apply.
